Terms of Service
Preamble
These Terms of Service (the "Terms") constitute a binding agreement between IP Kuzmin S. (Individual Entrepreneur, Republic of Belarus; "we", "Khut") and any user of the service "Khut-Mova" ("you", "User").
By creating an account via Google OAuth and ticking the consent checkbox on the sign-in screen, you accept these Terms. If you do not agree, do not use the Service.
These Terms are intended for the Belarusian diaspora and other international users accessing the Service from outside Belarus. For Belarusian residents the primary legal document is the Belarusian-language Public Offer.
1. Definitions
- Service — the software product "Khut-Mova" available at https://khut.by, an AI tutor for the Belarusian language.
- Account — the User's personal record in the Service.
- Content — text messages generated by the User or by the AI model.
- Free tier — the basic set of features provided without payment (currently the only tier).
2. Eligibility
2.1. You confirm that you have full legal capacity under the civil legislation of your country of residence to enter into this agreement.
2.2. The Service is not targeted at residents of the Russian Federation within the meaning of Russian Federal Law 152-FZ. If you reside in the Russian Federation, please use the Service at your own risk; we do not localise or market into Russia.
2.3. Some AI providers we rely on (notably OpenAI and Google AI Studio) do not list Belarus among officially supported countries. The Service may experience interruptions or degraded AI functionality as a result. See the Privacy Policy for details.
3. Grant of licence
3.1. We grant you a non-exclusive, non-transferable, revocable, limited licence to use the Service for personal, non-commercial purposes — learning the Belarusian language.
3.2. The Service is an information-technology service, not an educational service in the regulated sense. We do not issue diplomas, certificates, or accredited qualifications.
3.3. We make no guarantee that you will achieve any particular level of proficiency.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes, including creating illegal, extremist, sexually explicit, or deliberately false content.
- Attempt to hack, reverse-engineer, rate-limit-abuse, scrape, or overload the Service.
- Share your account with third parties or create multiple accounts to circumvent limits.
- Use the Service for commercial or bulk purposes without our prior written consent.
- Submit personal data about third parties without their consent.
- Use the Service in violation of applicable export-control or sanctions laws.
Breach of this clause is grounds for immediate suspension or termination of your account without refund.
5. AI, hallucinations and no warranties
5.1. The Service uses third-party large language models (Google Gemini primary, OpenAI GPT-4o-mini fallback). See section 4 of the Privacy Policy for the full list of processors.
5.2. AI responses may contain inaccuracies, hallucinations and errors. Do not rely on AI output as your sole source for:
- medical, legal, financial or safety-critical questions;
- normative spelling / grammar decisions.
5.3. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
5.4. To the maximum extent permitted by law, our aggregate liability to you for any claim related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim or (b) €100. For the free tier the liability cap is effectively zero.
6. Fees and refunds
6.1. The Service is currently free of charge. A paid subscription may be introduced later; these Terms will be updated accordingly (see section 10).
6.2. When paid subscriptions are introduced:
- You will have a 14-day refund right from the start of the subscription if you have not materially used paid features (mirroring EU Directive 2011/83/EU and Belarusian consumer-protection law № 90-Z of 09.01.2002).
- Refund requests: hello@khut.by.
6.3. EU consumers retain statutory rights under Directive 2011/83/EU, including the right of withdrawal for distance contracts where applicable.
7. Account termination
7.1. You may delete your account at any time through the Service UI or by emailing hello@khut.by.
7.2. After deletion we remove profile, chats, reactions and feedback from the live database within 15 business days and from backups within 30 days. Accounting records are retained as required by Belarusian tax law (if any payments were made).
7.3. We may suspend or terminate your account for breach of section 4 or of applicable law. We will provide written notice where reasonably possible.
8. Intellectual property
8.1. The Service, its code, design, curriculum and brand are owned by the Operator or its licensors.
8.2. You retain ownership of the Content you enter. By using the Service you grant us a non-exclusive, worldwide, royalty-free licence to process your Content for the purpose of providing the Service (including transmitting it to AI processors listed in the Privacy Policy).
8.3. We do not use your Content to train AI models; we use API access with training opt-out as per each provider's standard terms.
9. Force majeure and third-party dependencies
9.1. We are not liable for interruptions caused by:
- failures of infrastructure partners (Supabase, hostfly.by, Google, OpenAI, Portkey);
- sanctions or export-control actions by third parties;
- force majeure (natural disasters, acts of war, government decisions, internet shutdowns).
10. Changes to the Terms
10.1. We may update these Terms. Material changes will be announced via email and/or an in-app banner at least 14 days before they take effect.
10.2. If you disagree with the changes you must stop using the Service and may delete your account. Continued use after the effective date constitutes acceptance.
11. Governing law and dispute resolution
11.1. These Terms are governed by the laws of the Republic of Belarus.
11.2. Disputes are submitted to the competent court at the place of the Operator's registration (Minsk, Republic of Belarus), without prejudice to mandatory consumer-protection rights that the User may have in their country of residence (in particular, EU consumers retain the protections of Regulation (EU) 1215/2012 and Directive 2011/83/EU).
11.3. EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
